Important Reminder – Food Processing Facilities Need to Register with FDA
U. S. Food and Drug Administration (FDA) Bioterrorism Legislation

The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (the Bioterrorism Act) directs the Food and Drug Administration (FDA), as the food regulatory agency of the Department of Health and Human Services, to take additional steps to protect the public from a threatened or actual terrorist attack on the U.S. food supply and other food-related emergencies. To carry out the provisions of the Bioterrorism Act, FDA published, on October 10, 2003, an interim final regulation, Registration Of Food Facilities, which requires domestic and foreign facilities that manufacture/process, pack, or hold food for human or animal consumption in the United States to register with the FDA.
This is a reminder for all facilities that process food (including seafood, food for livestock and pets) – they must be registered with FDA. There are NO FEES to register.
Who must register? The owner, operator, or agent in charge of a domestic or foreign facility that manufactures/processes, packs, or holds food for human or animal consumption in the U.S., or an individual authorized by one of them, must register that facility with FDA. A domestic facility must register whether or not food from the facility enters interstate commerce.
If you are required to have a HACCP Plan then YOU ARE required to register with FDA.
If you manufacture feed to be fed to livestock that is sold in retail business, YOU ARE required to register with FDA. Farmers are exempt if they manufacture feed that is consumed by livestock on their property or property owned by the farmer.
Fee fishing operations DO NOT need to register if they are only providing a service (cleaning, filleting) for your customers and are not processing fish for retail trade.

How to register: Facilities can register online at - https://www.access.fda.gov/ (see information in upper left column). Facilities can fill out application (see link to Registration form at bottom of story ) and fax the information to 301-436-2804 or 1-866-573-0846. If a facility does not have reasonable access to the Internet, a paper copy of the form may be obtained from FDA by calling 800-216-7331 or 301-575-0156 or by mailing a request to:

The information provided on the registration IS NOT available to the public, nor is the list of facilities registered.
“Holding food” is not holding food for your livestock operation (fish food storage) therefore you are NOT required to register just because you store feed for your fish.
